Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of the website at breachingtechnologies.com and any related ordering, quote, or account services (collectively, the “Site”) operated by Breaching Technologies, Inc. (“BTI,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Quotes and pricing
Product information and any retail pricing shown on the Site are provided for general information and may change without notice. A price quote is an estimate, not a binding offer, and is subject to confirmation by BTI, product availability, applicable taxes and freight, and any distributor, GSA, or contract pricing for which you qualify. An order is binding only when accepted and confirmed by BTI.
Accounts
Certain features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
Product eligibility and lawful use
BTI manufactures tactical breaching tools, training doors, and related equipment intended for military, law enforcement, fire/rescue, and other qualified professional users. You represent that your purchase and use of BTI products is lawful and for legitimate purposes, and you agree to comply with all applicable laws and regulations, including any export-control and end-use requirements. BTI may decline or cancel any order at its discretion.
Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, its systems, or other users’ data;
- Interfere with or disrupt the integrity or performance of the Site;
- Reproduce, scrape, or harvest content except as expressly permitted.
Intellectual property
The Site and its content — including text, graphics, logos, product images, and software — are owned by BTI or its licensors and are protected by intellectual-property laws. “Breaching Technologies” and related marks are the property of BTI. You may not use them without our prior written permission. We grant you a limited, revocable, non-transferable license to access and use the Site for its intended purpose.
Third-party services
The Site relies on third-party providers — including hosting, email delivery, payment processing, and Intuit QuickBooks Online for invoicing and accounting — to deliver our services. Your use of those services through the Site may be subject to the providers’ own terms and policies. BTI is not responsible for the content or practices of third-party services.
Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Product warranties, where offered, are stated separately in BTI’s product documentation and order terms.
Limitation of liability
To the fullest extent permitted by law, BTI and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed the amount you paid, if any, for the applicable transaction.
Indemnification
You agree to indemnify and hold harmless BTI from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
